Petty Theft



Petty theft is distinguished from grand theft based on the value of the property. Petty theft is inherently petty theft when it is $950 below in terms of value. Theft is inherently grand theft when it is above $950 in value. However, this is no harden fast rule that says for example that two..three..five thousand dollars worth of goods couldn’t be charged as petty theft. It’s a prosecutorial discretion and sometimes even though property could be valued more it doesn’t merit the higher charge and grand theft and petty theft could be punished very similarly in the overall scheme of things. Grand theft could and often is a misdemeanor or could be and is often is a misdemeanor and petty theft is always a misdemeanor.
